Terms of Service
These Terms of Service ("Terms") govern your access to and use of The Agent Marketplace (the "Service"), available at theagentmarketplace.ai. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The service
The Agent Marketplace is a two-sided platform where you can (a) learn to build AI agents in a live, interactive academy, and (b) discover, run, and purchase agents published by other creators. The academy teaches agent-building through real code and live agent runs; mastery is graded server-side and tracked per learner.
2. Accounts
- You may browse and use parts of the Service anonymously. Certain features (saving progress, publishing or purchasing agents, earning credentials) require an account.
- You are responsible for the activity under your account and for keeping your credentials confidential. Notify us promptly of any unauthorized use.
- You must provide accurate information and be legally able to enter into these Terms in your jurisdiction.
3. Acceptable use
You agree not to:
- Use the Service to build, publish, run, or distribute agents that are unlawful, harmful, deceptive, infringing, or that violate the rights or privacy of others;
- Attempt to disrupt, reverse-engineer, overload, or gain unauthorized access to the Service or its infrastructure;
- Submit content you do not have the rights to, or that contains malware or abusive material;
- Circumvent grading, payments, usage limits, or access controls.
We may suspend or terminate accounts that violate these Terms.
4. The agent marketplace
Creators may publish agents on the marketplace and offer them for free or for a one-time price. The Agent Marketplace operates on a platform-collect model: we facilitate the listing and the sale, collect payment on the creator's behalf through our payment processor, and remit the creator's share less applicable platform fees.
- Creators retain ownership of the agents they publish but grant us a license to host, display, demo, and sell them through the Service. Creators are responsible for ensuring their agents are lawful and do not infringe third-party rights.
- Buyers purchasing an agent receive the access described on the listing — typically the ability to run the agent live and to unlock its underlying recipe. Purchases are one-time and grant a personal, non-transferable license to use the agent within the Service.
- We do not guarantee the accuracy, suitability, or output of any agent. Agents are provided by their creators.
5. Payments
Paid agents are sold for a one-time price shown at checkout. Payments are processed by Stripe; we never receive or store your full card details. By purchasing, you authorize the charge for the listed amount. Refunds are handled per our Refund & Cancellation Policy.
6. Intellectual property
The Service, including the academy content, software, and branding, is owned by us or our licensors and is protected by intellectual-property laws. Except for rights expressly granted, no rights are transferred to you. Credentials issued by the Service certify your demonstrated mastery and may be shared, but may not be altered or misrepresented.
7. No warranty
The Service and all agents are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service or any agent will be uninterrupted, error-free, or produce any particular result.
8. Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total aggregate liability arising out of or relating to the Service or these Terms is limited to the greater of (a) the amounts you paid us in the twelve (12) months before the claim, or (b) USD 100.
9. Termination
You may stop using the Service at any time and may request deletion of your account (see our Privacy Policy). We may suspend or terminate access for breach of these Terms or to protect the Service. Provisions that by their nature should survive termination (e.g., IP, disclaimers, liability limits) will survive.
10. Changes
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above and, where appropriate, additional notice. Continued use after changes constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the state and federal courts located in Chicago, Illinois.
